Privacy Policy

NEXPLORE (hereinafter "NEXPLORE", "we", "our" or "us") takes the protection of your personal data seriously and handles your data strictly in accordance with the provisions of the General Data Protection Regulation (GDPR).

This Privacy Policy explains how your personal data is collected, used, and disclosed by Nexplore, if and insofar Nexplore determines the purposes and means of the processing of your personal data and, thus, acts as the "Controller" within the meaning of the GDPR. Within this scope, this Privacy Policy applies to our application (the "App"). Your use of the App requires that you have read, understood, and agree to our collection, storage, use, and disclosure of your personal data as described in this Privacy Policy and our Terms of Services.

Please note that Nexplore does not offer the App to end users. Instead, we license the App to our third party customers ("Service Provider(s)") for their own use and we provide certain service to the Service Providers to operate the App. The relationship between us and the Service Provider constitutes the business proposal of Software as a Service ("SaaS"). Under the SaaS model, it is the Service Provider (and not Nexplore) who offers and permits the use of the App by you subject to Terms of Use agreed between you and the Service Provider before the Service Provider grants you access to the App. Further, in the SaaS model, it is the Service Provider who determines the purposes and means of the processing of your personal data by the App and, thus, acts as the "Controller" within the meaning of the GDPR. Your access to and use of the App will therefore be subject to your agreement with the Service Provider's own privacy policy which is presented to you during your registration for the App with the Service Provider. Our role in the SaaS model is that of the "Processor" as defined in the GDPR: We may process your personal data (such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction). This processing, however, is carried out on behalf of the Service Provider (and Controller) under a contract between us and the Service Provider in accordance with Art. 28 GDPR in order to safeguard your personal data.

The following Privacy Policy is, therefore, only applicable if and insofar Nexplore would act as the "Controller" in connection with your use of the App, whereas your use of the App subject to your registration with a Service Provider is regulated by the Privacy Policy of that Service Provider (as presented to you upon your registration with the Service Provider) and in this scope the following does not apply (but the Privacy Policy of the Service Provider).

On this basis, we would like to inform you on the following:


1. Contact details of the controller

This App is operated by NEXPLORE Technology Holding GmbH & Co. KG, Alfredstraße 236, 45133 Essen, Tel. 0201 824-0, Fax 0201 824-2777, info@nexplore.com, Commercial register: HRA 10906, Registration court: Essen, Commercial register: HRB 29508, which is also solely responsible for any data processing procedures associated with the use of the App, unless otherwise stated herein, in particular in the event that you have been provided with and allowed access to the App by the Service Provider under the SaaS model. In this case the Service Provider's own privacy policy, presented to you during your registration for the App with the Service Provider applies.

NEXPLORE has appointed a Data Protection Officer whom you can contact at any time regarding all questions on the subject of data protection at the address of the controller with the addition of "The Data Protection Officer" or by e-mail to info@nexplore.com.

3. Data processing activities when using the App

What personal data does the App collect?

The App collects two basic categories of personal data.

Personal data you provide

When you interact with the App, the App collects personal data that you provide. The use of the App requires you to create an account and provide personal data about you, such as your name, username, password and email address.

Personal data the App receives

When you use the App, the App collects information on which of the services you used and how you used them. The App may capture images, photos and other data from your camera and gallery. When you use the App, the App may collect information about your location using GPS, wireless networks, cell towers, Wi-Fi access points, and other sensors such as gyroscopes, accelerometers, and compasses.

How does the App use the personal data it collects?

Any of the personal data the App collects from you it uses for the registration process and login for the created account.

Does the App share the personal data it collects with third parties?

The App may share the personal data that it collects, both personal and non-personal, with our current and future affiliated companies and business partners, in particular the relevant Service Provider (as explained in detail above).

The App may engage trusted third party service providers to perform functions and provide services to us, such as hosting and maintaining our servers and our service, database storage and management, e-mail management. The App will likely share your personal data, and possibly some non-personal data, with these third parties to enable them to perform the services for us and for you.

Does the App use your email address?

By submitting your email address on this App, you agree to receive emails. You can cancel your participation in any of these email lists at any time by clicking on the opt-out link or other unsubscribe option that is included in the respective email. The App only sends emails to people who have authorized us to contact them, either directly, or through a third party. The App does not send unsolicited commercial emails.

Is my personal data transferred to third countries?

We are incorporated in Germany. Personal data the App collects may be viewed and hosted in third countries, in particular to one or more countries for which the Service Provider offers use of the App and/or where the Service Provider is located.

How long does the App keep your personal data?

The App keeps your personal data only so long as the App needs it to provide services to you and fulfill the purposes described in this Privacy Policy. When the App no longer needs to use your personal data and there is no need for use to keep it to comply with our legal or regulatory obligations, the App will either remove it from our systems or depersonalize it so that we cannot identify you.
